What should you do if you or your loved one is detained?

Before anything, if you have sensitive status it is important to know your rights, make a family preparedness plan, and seek legal advice.

Accessing Legal Advice

  • Only utilize licensed attorneys or accredited representatives
    • Attorneys are licensed by state bar organizations, usually with published disciplinary history (if any): HERE

  • A serious practitioner will want to have a consultation before finalizing the cost and scope of service
  • Catholic Charities of Northern Nevada maintains an extensive referral list.
  • The UNLV Immigration Clinic: If you are detained, call 702-895-3000.

If you are detained: 

Consult with an immigration attorney or an accredited representative before you: 

  • Provide more information than your name and date of birth
  • Sign any document presented to you by an immigration enforcement officer
  • Pay any bonds in a criminal case
  • Accept any resolution to your immigration case
  • Waive your right to appeal

How to locate your loved one? Step-by-step guide:

1. Retrieve your loved one’s information:

    • It is important to have your loved one’s complete name, date of birth, country of origin, and, if possible, their A-number

2. Use the ICE Locator: locator.ice.gov 

    • Things to keep in mind: 
      • Will show people in ICE custody, but will not show people in criminal custody who also have ICE holds
      • Takes time to update, so it may be outdated at times, or list people as “in transit”
      • Name-search function is strict and may require multiple attempts [Juan Sanchez-Ortega; Juan Sanchez Ortega; Juan Sanchez; Juan Ortega])

3. If they’re not in the ICE Locator, call the holding facility:

    • RENO Area:
      • Visit the Washoe County Jail website, but keep in mind that it will only show people with at least one criminal charge – Inmate Search. You can also contact their booking department at 775-328-3001 (press 1 then 4) to confirm whether a person is in detention regardless of the custody status.
      • You can also contact or visit the Reno ICE Field Office, but please keep in mind that only people with permanent status should contact or visit ICE.

    • SmartInmate is a video and text messaging tool that allows you to connect with detainees, including most ICE detainees, once you have located them (an account is required): Smart Communications

      • You can also contact or visit the Las Vegas ICE Field Office, but please keep in mind that only people with permanent status should contact or visit ICE.

4. Try the Immigration Court Portal,

  • You can also try the Immigration Court Portal, but it will require the individual’s Alien Registration Number. It will not show people who have not been placed in formal removal proceedings: https://acis.eoir.justice.gov/en

5. Contact the consulate

  • If you’re unable to locate your loved one, you can also contact the consulate of the detainee’s country of origin by finding the contact information here. Here is a list of consulates based in Nevada.
